When Performance or behavior issues are raised we often see a counter claim from the employee that they are being bullied by the manager or feeling stressed. Sometimes this is mixed with genuine mental health issues.
A recent Employment Court Decision (FGH v RST) addressed what steps an employer mist take to manage their health and safety obligations in the context of a genuine performance concern and diagnosed mental health issues. The Court determined the steps taken by the employer were not sufficient enough to meet their legislative health and safety obligations.
